Subject to any declarations by Member States on the non-applicability of certain provisions of the Regulation, the following applies:

  • In accordance with Regulation (EU) 2020/698, the validity of the code 95 marking entered on a driving licence or a driver qualification card that has expired or would have expired between 1 February 2020 and 31 August 2020 is (automatically) deemed to have been extended by seven months from the date stated on the respective driving licence or driver qualification card. The time limit for the completion of periodic training that has expired or would have expired between 1 February 2020 and 31 August 2020 is also deemed to have been extended by seven months.


  • Regulation (EU) 2021/267 now makes provision for the following:

    • If the codes entered on a driving licence or a driver qualification card or the deadlines for periodic training were deemed to have been automatically extended in accordance with Regulation (EU) 2020/698 (see above) and if this fictional validity expires between 1 September 2020 and 30 June 2021, these codes will be deemed to have been extended (automatically), in accordance with Regulation (EU) 2021/267, by another six months or until 1 July 2021, whichever is the later.
    • Moreover, in accordance with Regulation (EU) 2021/267, the validity of the code 95 markings entered on a driving licence or a driver qualification card that has expired or would expire between 1 September 2020 and 30 June 2021 (and that have not yet deemed to have been extended once in accordance with Regulation (EU) 2020/698)) is (automatically) deemed to have been extended by ten months. The time limit for the completion of periodic training that would have expired or has expired between 1 September 2020 and 30 June 2021 (and that has not yet deemed to have been extended once in accordance with Regulation (EU) 2020/698) is also deemed to have been extended automatically by ten months.
    • By resolution of June 30, 2021, the Commission approved the application by the Federal Republic of Germany to extend the reference period beyond June 30, 2021. Accordingly, the deadlines for further training, the key numbers 95 entered in the driver's license or in the driver qualification certificate and the driver qualification certificates themselves, which otherwise expired or would expire between July 1, 2021 and September 30, 2021 (automatically), are extended by ten months .

      Please note: This applies only within the EU; until 1 January 2021, the rules set out in Regulation (EU) 2020/698 (but not Regulation (EU) 2021/267) applied in the UK as well.


  • In accordance with Regulation (EU) 2020/698, the validity of driving licences harmonised within the EU (in Germany, this only applies to driving licence categories C, CE, C1, C1E, D, D1, DE, D1E) that has expired or would have expired between 1 February 2020 and 31 August 2020 is (automatically) deemed to be extended by seven months from the original date of expiry stated on the respective driving licence, without further conditions having to be complied with.


  • Regulation (EU) 2021/267 now makes provision for the following:

    • If the validity of the aforementioned driving licences was deemed to have been extended automatically in accordance with Regulation (EU) 2020/698 (fictional validity) and if this fictional validity would now expire (again) between 1 September 2020 and 30 June 2021, the validity period of the aforementioned driving licences is to be deemed to have been extended (automatically) by another six months or until 1 July 2021, whichever is the later.
    • In addition, the validity of driving licences harmonised within the EU (in Germany, this only applies to driving licence categories C, CE, C1, C1E, D, D1, DE, D1E) that has expired or would expire between 1 September 2020 and 30 June 2021 is (automatically) deemed to have been extended by ten months.
    • By resolution of June 30, 2021, the Commission approved the application by the Federal Republic of Germany to extend the reference period beyond June 30, 2021. Accordingly, the period of validity of driving licenses harmonized within the EU applies (in Germany only applies to driving license classes C, CE, C1, C1E, D, D1, DE, D1E), which otherwise expires between July 1, 2021 and September 30, 2021 are or would expire (automatically) as being extended by ten months.
      Please note: This applies only within the EU; until 1 January 2021, the rules set out in Regulation (EU) 2020/698 (but not Regulation (EU) 2021/267) applied in the UK as well.

  • Tachographs in road transport, renewal or replacement of driver cards: The deadlines for issuing driver cards laid down in Regulation (EC) No 165/2014 are extended. This does not apply to the deadlines for submitting an application laid down in Regulation (EU) No 165/2014; they continue to apply without any changes.


  • The validity of Community licences and driver attestations in accordance with the time limits laid down in Regulation (EC) No 1072/2009 that would have expired or would expire between 1 September 2020 and 30 June 2021 is extended by ten months.


  • Validity of Community licences in passenger transport: The time limits laid down in Regulation (EC) No 1073/2009 that would have expired or would expire between 1 September 2020 and 30 June 2021 are extended by ten months.


  • Germany has objected to the extension of the intervals of main inspections in accordance with Article 5(1) and (2) of Regulation (EU) 2020/698 as well as according with Article 5(1) and (2) of Regulation (EU) 2021/267. Thus, the inspection intervals remain unchanged and the basic provisions of Section 29 in conjunction with Annex VIII of the German Road Vehicles Registration and Licensing Regulations (StVZO) continue to apply.
